Definitions


For purposes of this Privacy Notice and Security Information, following are definitions of terms used herein:


1. “Data” shall mean data, material, or information submitted or provided by you through the use of the Services.

2. “License” shall mean that sublicense or license agreement and/or other terms and conditions entered into by you and/or your employer allowing you and/or others to use the Services.

3. “Services” shall mean those services provided by us on a specific website and web server(s), including, but not limited to, software that can be downloaded from such website and web server(s) that can be utilized on a computer, PDA, or other device. These Services primarily relate to the commercial janitorial or communication fields.

4. “User” shall mean those who have received a user name and password from us in order to use the Services.

5. “You” and “Your” in any form shall mean you, the User who uses the Services, your employer, and all other Users of your employer.

6. “We”, “Us”, and “Our” in any form shall mean CleanBrain Software, Inc.



Updates


This Privacy Notice and Security Information is subject to change without notice. As updates or changes are made, we will post the revised Privacy Notice and Security Information on our website. You will be able to access it at the log on screen to use the Services and while using the Services. Please check the Privacy Notice and Security Information frequently as to view all changes, if any, which are made. By logging on to our website or to use the Services, you accept the practices described in this Privacy Notice and Security Information and any updates or changes thereto. In the event of any conflict, inconsistency or discrepancy between the terms and conditions in the License and the practices set forth in this Privacy Notice and Security Information, the terms and conditions in the License shall govern.

How we feel about your privacy.


We recognize that your Data must be protected. The privacy of your Data is a high priority to us. We are committed to doing our very best to safeguard your Data and privacy online. Our Policy Notice is designed to help you understand how your Data will be treated.


Data you provide or submit.


We receive and store your Data. You can choose not to provide certain Data, but then you might not be able to use the Services as they are intended to be used. Typically Data we store about you includes, but is not limited to, information about you and your company (i.e. names, addresses, email addresses, management levels, and contact numbers), information about the clients that you may communicate with (i.e. names, addresses, email addresses, management levels, and contact numbers), information about the buildings or areas that you may provide services to (i.e. measurements, service schedule, cleaning specifications, personnel assignments, and supply and other costs), and communication history between you and those whom you may provide services for.


How we use your Data.


We may access and use your Data for the following purposes or under the following situations, and as set forth in your License:


  1. To set up the Services for you.

  2. To resolve technical support questions.

  3. To resolve problems or errors in the Services.

  4. To improve the Services.

  5. To send limited and necessary information to a third party who provides support services for us, such as sending and receiving emails.

  6. To contact you.

  7. To contact, solicit, and/or enter into agreements with others regarding their use of the Services and/or other services we provide.

  8. To send information to you.

  9. Suspected violation of the License.

  10. As required by law to resolve disputes and litigation.

  11. To determine amounts to charge for the use of the Services.

  12. To collect and store information about your visit to use the Services for internal purposes. This information may include the time and length of your visit, the pages you look at on our sites, and any site that you may have visited from which you linked to our site. We may also record the name of your Internet service provider and your IP address. We use this information to measure site activity and to develop ideas for improving our sites.


Your options.


We may have certain information to send to you that you may choose whether or not to receive from us. You may opt out of receiving that information from us at any time by sending your request along with your contact information to privacy@cleanbrain.com.



Third party sites.


The Services may contain links to other web sites. We are not responsible for the privacy practices or the content of these other web sites. It is your responsibility to check the privacy policies of these other web sites.



Security Information



How we feel about the security of your Data.


We recognize that your Data must be protected. The security of your Data is a high priority to us. We are committed to doing our very best to safeguard your Data. Below is information about the security in place to help safeguard your Data:



Your Data is stored on our server(s).


We own, lease, or rent the server(s) that store your Data and that run the application that provides the Services. The server(s) used by us to distribute and receive emails is owned by a separate company that provides these and other support services for us. This company has access to those parts of your Data needed to perform their responsibilities, but may not use your Data for any other purposes. They have agreed to keep those parts of your Data that they may access confidential and to not share or sell your email addresses to third parties. In this regard, for confidentiality purposes only and for confidentiality purposes only in the “Limited access to employees” section below, “Data” shall not include data, material, or information that is (a) generally available to the public at the time of disclosure, or which, thereafter, through no act or failure to act on our part becomes generally available to the public; (b) generally known in the industry in which you do business; (c) that is readily ascertainable by proper means by your competitors, through sources independent of you and/or us, through no act or fault of us; or (d) which, prior to the receipt of the same, was known to us.


Limited access to employees.


We limit employee access to your Data to those who have a business reason to know the information. Each employee is required to enter into a confidentiality agreement with us.


Secure Location.


The server(s) we use are secure in a locked server cabinet located off site within a state-of-the-art co-location facility with redundant air conditioning, multiple backup generators, redundant UPS systems, redundant self-healing tier-1 network backbone, firewall, biometric access locks, and live monitored video surveillance systems 24/7/365. Multiple levels of security must be passed before reaching the locked server cabinets.


Your Data is backed up.


Your Data is backed up using automated back up systems on and off site.


We use encryption technology.


We use Secure Socket Layer (SSL) technology which helps protect your information using both server authentication and data encryption. SSL is a protocol designed to enable applications to transmit information back and forth securely. We are using SSL with 128 bit encryption which means that it uses approximately 340,282,366,920,938,463,463,374,607,431,768,211,456 unique encryption codes (or about 340 trillion trillion trillion unique encryption codes), encrypting your Data as it moves between your computer’s browser and our server(s). In order to use the benefits of the SSL technology, you must use an Internet browser that supports SSL 128 bit encryption. We use Digicert for our SSL digital certificates (www.digicert.com).


Cookies.


When you log on to the Services, our server(s) may send “cookies” to your computer. A cookie is a small piece of information sent by a web server to your web browser and stored on your hard drive so that it can later be read back from the browser. Cookies help web sites to keep track of your preferences and to recognize return visitors. So, when you return to a web site you’ve visited before, your browser gives this data back to the server. Cookies do not contain viruses and most cannot reveal any personally identifiable information about you unless you willingly provide it as a user on a site.


There are two types of cookies: session and persistent-based. Session cookies only exist during an online session. They disappear from your computer’s hard drive after you close your internet browser or turn off your computer. Persistent-based cookies stay on your computer’s hard drive after you have closed your internet browser or turned off your computer.


We use cookies to make your online experience with us richer and more personalized. We may use a session cookie to record information for the duration of a specific session.


We provide each User a unique user name and password. If you choose to have your computer remember your user name and password, we will use a persistent-based cookie to record your user name and password and other information on your computer. We recommend that you do not choose to have your computer remember your user name and password if others may have access to your computer. Others may find out your user name and password if they have access to your computer.


You must enable cookies to be used on your computer or you will not be able to use the Services.



What you can do.


The privacy and security of your Data is a high priority to us. We have several security features that we have implemented for the protection of your Data. Although we are confident of its protection, no data transmission over the Internet can be guaranteed to be 100% secure. We cannot ensure or warrant the security of any Data you transmit to us, and you do so at your own risk. You are solely responsible for the confidentiality of your Data. Once we receive Data from you, we do our best to ensure its security and privacy on our systems. There are certain things you can do to help with the security and privacy of your Data. Some suggestions are:


  1. Keep your user name and password confidential.

  2. Change your password if you suspect that anyone else has seen it or knows it.

  3. Be sure to log off before leaving your computer, especially if it is a shared computer.

  4. Log off before surfing other sites on the Internet.
